How we handled A Case of defaulting tenants

The landlord had a tenant default in paying rent and continuously go back on his word to pay for close to a year. Their property manager gave up on the situation handing back the management of the house in a state of five months’ rent arrears when Covid 19 disruptions to the economy were at peak in June 2021. The tenant continued to default and in October 2020, the client made a call to Property Access following a referral who knew of our vast experience and skill in property management. He asked us to manage the termination of the tenancy and letting the house. 

Property Access contracted to assess and advise on the available options to mitigate losses. With eight months’ rent arrears, the security deposit was already exhausted, the house would require to be renovated and the tenant has also accumulated service charge fees and utility bills amounting to two months’ rent. Essentially, an immediate termination was likely to result in loss of a year’s rent. 

Property Access advised the landlord to recover the rent and unpaid bills before terminating the tenancy to minimise the loss. Property Access therefore contracted to recover the accumulated rent arrears and manage the termination process. Upon engagement with the tenant, the rent arrears and additional rent due was all paid off within four months (January 2021) and the termination of the tenancy as stipulated in the tenancy agreement commenced. 

The tenant moved to court to delay the termination process and PA is now managing the litigation process on behalf of the landlord.
